Scope. These Terms of Use ("Terms") govern access to and use of the corporate marketing site at https://gridsphere.energy (the "Site"). The SIMULA software product available at simula.gridsphere.energy is governed by a separate Terms of Service.

1. Site purpose and B2B scope

The Site is a corporate marketing site that describes GridSphere SA's BESS commercialisation platform, services, and corporate information. The Site is addressed to professional / B2B audiences (project developers, energy operators, advisors, suppliers, investors). The Site does NOT operate user accounts, does NOT process payments, and does NOT provide any software product on this domain.

2. Acceptable use

By accessing the Site you agree:

  1. to use the Site only for lawful purposes and in accordance with these Terms;
  2. not to attempt to interfere with the operation of the Site (penetration testing, automated scraping at scale, denial-of-service activity, or similar);
  3. not to use the Site to transmit unsolicited communications, malware, or unlawful content;
  4. to provide truthful, accurate information when submitting any form on /contact/.

3. Intellectual property

All content published on the Site — including text, graphics, illustrations, logos, layout, and branding — is the property of GridSphere SA or used under licence. You may quote brief excerpts with proper attribution and a link to the source page, in accordance with fair use / quotation rights under applicable law. Any other reproduction, redistribution, or derivative use requires GridSphere SA's prior written consent.

The trademarks "GridSphere", "SIMULA" and "ec-storage" (when used in the GridSphere context) are the property of GridSphere SA. Other trademarks referenced on the Site belong to their respective owners.

4. External links

The Site may include links to third-party websites for the convenience of users. GridSphere SA does not endorse and does not control the content of those external sites and accepts no responsibility for the content, availability, or practices of third parties.

5. No warranty on content

Information published on the Site is provided "as is" for general information. GridSphere SA endeavours to keep content accurate and current but does not warrant that all information is free from error or omission. The Site is not a substitute for engineering, financial, regulatory, or legal advice tailored to your specific project. Any commercial offer or proposal will be made through a separate written communication, not on the Site.

Forms on /contact/ are processed under the Privacy Policy. Submitting a form constitutes a request for pre-contractual information; it does NOT constitute the conclusion of any contract or commitment by GridSphere SA. GridSphere SA replies to enquiries on a best-efforts basis and reserves the right to decline any enquiry.

GridSphere SA may modify these Terms at any time. Material changes will be communicated by updating the "Effective date" above. The current version is always available at this URL. Continued use of the Site after a change constitutes acceptance of the modified Terms.

10. Governing law and forum

10.1 Governing law

These Terms are governed by the substantive law of Switzerland, without reference to its conflict-of-law rules.

10.2 Forum

Any dispute arising from access to or use of the Site shall be subject to the exclusive jurisdiction of the courts of Lugano, Canton Ticino, Switzerland, subject to the non-waivable protections of any applicable consumer-protection rule.
